I could not listen to this whole post because I used to work for a very bad lawyer and I learned there that in most cases the victim gets very little compensation, the lawyers get most of it anyways. And there is NO way they are going to give that up. I would hate to see the victims get any less than they already are. I know in some publicized cases this is not true, but in the cases that I watched happening from the inside, victims got very little. I think they try to publicize the exceptions to generate greed and start more lawsuits. I know that my boss told me that he was very angry that I did not encourge all of my friends to come to him and file suits. I wanted to say "It is because YOU SUCK" but I really needed the job.
The whole idea is to turn the tables on the greedy lawyers. Punitive awards belong to the state, not to the lawyers or the victim. The law would have to include a formula which gives the lawyers a fair amount for court costs - 10% of what the victim is awarded should be the cap. It would have to be done by Proposition, because there are too effing many lawyers on the take in the legislature to pass a bill the easy way.
I think that without the greed factor the lawyers would not bother taking any cases. Let me tell you, they SUCK. I know this from being around them a lot. I do have one who is a friend, but even he is kind of scummy.
It depends on the lawyer. I know some sucky greedy ones, but I have two cousins who are lawyers, one represents non-union farm workers and the other bounty hunts companies which have violated environmental laws. Both manage to make a good living. I have two theater friends who are lawyers, one is a researcher for the county appeals court and the other is a major league trial lawyer who made megabucks, and invested a chunck of that into building a no-profit melodrama theater in Gold Country. He always played the villain.
